Adoptions are special proceedings before the clerk of superior court. To begin an adoption, a petition is filed with the clerk of superior court and an adoption is finalized with a decree of adoption issued by the clerk of superior court. To adopt in North Carolina, (1) the adoptee must have lived in North Carolina (a) at least six (6) consecutive months immediately preceding the filing of the petition or (b) from birth if the prospective adoptive parent is domiciled in this State; or (2) the adoptive parent(s) must have lived or been domiciled in North Carolina at least six (6) consecutive months immediately preceding the filing of the petition.
