A Prayer for Judgment Continued (PJC) is a finding of guilt without an entry of judgment for certain criminal or traffic offenses. A PJC is a remedy unique to North Carolina and may not be acknowledged by other states. As such, if you are interested in pursuing this option, it is important to work with an attorney familiar with NC traffic laws, like the team at Mercogliano & Associates, PA.
If a judge grants you a PJC on a traffic citation, you may not receive any insurance of DMV points on your license. However, traffic citation will still be visible on your driving record. An individual may use one (1) PJC every three (3) years per household for insurance point purposes, and two (2) PJCs every five (5) years for DMV point purposes.
Some judges may require community service or driving school in order to use a PJC. This is especially true when the traffic citation involves speeding in a school zone, speeding in a work zone, or high speed tickets. Furthermore, there is no guarantee that a judge will grant a PJC when requested. A PJC also cannot be used on some charges. For instance, a judge may not grant a PJC for Driving While Impaired. A PJC is also not available to one who is convicted of speeding more than twenty-five (25) mph over the speed limit. Additionally, a PJC is not recognized if you have a Commercial Drivers License (CDL).
